Gender and the Law Seminar
Course Description
This seminar will study the intersection of gender and law, as a conceptual issue, a doctrinal issue, and a justice issue. Towards this end, we will study legal issues that arise in doctrinal areas as diverse as constitutional law, family law, criminal law, and employment law, but with a particular focus on the fundamental question of what justice requires in the context of sex or gender differences. Within this framing, we will analyze the origin and content of several different conceptions of gender justice. We will interrogate the role of American law in creating basic fairness among its people, while also considering its capacity and obligation to do so. This seminar may be used to satisfy the Advanced Writing Requirement.
