Complex Civil Litigation

Course Description

This course will examine the complex procedural issues that arise in modern multi-party, multi-jurisdictional litigation.  It will focus primarily on two procedural devices—class actions and multidistrict litigation—and the most challenging issues that arise in litigation involving such devices.  Topics will include class certification, judicial review of class settlements, the Class Action Fairness Act, and the growing difficulty of bringing class actions in federal court, as well as the consolidation of multidistrict litigation, transfer, removal, and remand.  Finally, this course will consider the increasing prevalence of arbitration and alternative dispute resolution.
