Environmental Law Clinic student attorneys Jeremy Baker and Renée Lani argued before the Maryland Court of Special Appeals on May 10. The Clinic represents Potomac Riverkeeper Network on the appeal of a Clean Water Act discharge permit that the Maryland Department of the Environment (MDE) issued to the Upper Potomac River Commission. Baker and Lani argued that the permit should be remanded to MDE for consideration of important issues related to the implementation of the Chesapeake Bay Total Maximum Daily Load and protecting the recreational and aesthetic quality of the North Branch of the Potomac River.
Brent Walls from the Potomac Riverkeeper praised the students, saying "The students did an excellent job interacting with the judges. They stayed on point and reaffirmed that excessive changes to a permit without public involvement warrants a remand back to the State. The students represented the public’s right to be fully involved in protecting clean water in their Potomac River."
