Archive Developments in State Business & Technology Courts

Jun. 23rd, 2009 - The Daily Record of North Carolina reported the new facility for the Norman Adrian Wiggins School of Law at Campbell University is nearing completion. In addition to the law school, the new facility will house the North Carolina Business Court, Raleigh Division, making the facility one of a handfull in the country to host both a law school and a working court.

Jun. 19th, 2009 - The Poughkeepsie Jouranl notes a current state Supreme Court Justice on New York's Commercial Court was recently named the top judge in New York State's 9th Judicial District.

Jun. 19th, 2009 - A recent article in Mass High Tech noted a recent decision by the Business Litigation Section of the Massachusetts Superior Court involving noncompete agreements in the state. The court held that noncompete agreements in Massachusetts were generally enforceable even where the employee moved to another state where the agreements are not enforceable, such as California. This provides guidance to other courts faced with the issue, as this issue generally settles or is resolved after initial hearings.

May. 31st, 2009 - A recent article discussed the implications of the North Carolina Business Court's ruling on choice of law for malpractice claims against auditors. The Court ruled that state law where the audit is "performed, delivered and disseminated" governs auditor liability standards.

May. 17th, 2009 - An interview with the Mississippi Secretary of State addressed attempts to create a business court in that state. While the attempt failed this past year, business court legislation will be included in the limited liability reform package.

May. 4th, 2009 - The Atlanta Constitution-Journal reported that the Fulton County (Georgia) Business Court has proposed a transfer fee for new cases to fund the Court's operating costs. In addition, the county also wants to expand the number of judges sitting on the Business Court by rotating other judges through the Court.

Apr. 17th, 2009 - The ABA's Business Law Section recently issued a newsletter on a new Delaware law which expanded Delaware's Court of Chancery. The Court may now arbitrate business disputes even when there is no underlying litigation pending before the court.

Mar. 31st, 2009 - The WRAL Local Tech Wire posted an article detailing the efficiency of the North Carolina Business Court. The article provided a history of the Court, as well as the subject matter and advantages to using the Business Court, and encouraged potential litigants in North Carolina to use the Court when possible.
